AMENDMENT TO DECREE OF MINISTER OF INDUSTRY AND TRADE
NO. 230/MPP/Kep/7/1997
ON GOODS SUBJECTED TO THE IMPORT TRADE SYSTEM
AS ALREADY SEVERAL TIMES AMENDED,
THE LATEST BY DECREE OF MINISTER OF INDUSTRY AND TRADE
NO. 50/MPP/Kep/2/2000
THE MINISTER OF INDUSTRY AND TRADE ,
Considering :
- a. that in the framework of improving the efficiency of domestic industries and the smooth flow of goods, it is deemed necessary to amend the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1999 on Goods Subjected to the
Import Trade System as already several times amended, the latest by the Decree of the Minister of Industry and Trade No. 50/MPP/Kep/2/2000;
- b. that for that purpose, it is necessary to stipulate a Decree of the Minister of Industry and Trade.
In view of :
- 1. Law No. 5/1984 on Industry (Statute Book No. 22/1984; Supplement to Statute Book No. 3274);
- 2. Law No. 14/1992 on Traffic and Road Transport (Statute Book No. 49/1992, Supplement to Statute Book No. 3480);
- 3. Government Regulation No. 44/1993 on motor vehicles and drivers (Statute Book No. 64/1993, Supplement to Statute Book No. 3530);
- 4. Government Regulation No. 17/1996 on Authority to Govern, Promote and Develop Industries (Statute Book No. 23/1986, Supplement to Statute Book No. 3330);
- 5. Presidential Decree No. 136/1999 on the Status, Duties, Functions, Organizational Structure and Working System of Ministries;
- 6. Presidential Decree No. 355/M/1999 on Formation of the Cabinet for the Period of 1999-2004 as already amended by the Presidential Decree No. 98/M/2000;
- 7. Decree of the Minister of Finance No. 344/KMK.01/1999 on Amendment to Decree of the Minister of Finance No. 440/KMK.05/1996 on Stipulation of System of Classification of Goods and Rates of Import Duty on Imported Goods;
- 8. Decree of the Minister of Trade and Industry No. 230/MPP/Kep/7/1997 on Goods Subjected to the Import Trade System as already several times amended, the latest by the Decree of the Minister of Industry and Trade No. 50/MPP/Kep/2/2000;
- 9. Decree of the Minister of Industry and Trade No. 160/MPP/Kep/4/1998 on Amendment to the Decree of the Minister of Trade No. 77/Kp/III/78 on the Provision on Limited Trade Activities For Production Enterprises In the Framework of Capital Investment;
- 10. Decree of the Minister of Industry and Trade No. 444/MPP/Kep/9/1998 and No. 24/MPP/Kep/1/1999 on the Organization and Working System of the Ministry of Industry and Trade;
- 11. Decree of the Minister of Industry and Trade No. 275/MPP/Kep/6/1999 on Industry of Motor Vehicles;
- 12. Decree of the Minister of Industry and Trade No. 276/MPP/Kep/6/1999 on Registration of Types and Variants of Motor Vehicles;
- 13. Decree of the Minister of Industry and Trade No. 550/MPP/Kep/10/1999 on Importer's Identity Number (API).
DECIDES:
To Revoke:
1. The Decree of the Minister of Industry and Trade No.,49/MPP/Kep/2/2000 on Requirements for the Import of Motor Vehicle in Completely Built Up (CBU) condition.
2. The Decree of the Minister of Industry and Trade No. 50/MPP/Kep/2/2000 on Amendment to the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 on Goods Subjected to the Import Trade System as Already Several Times Amended, the Latest By the Decree of the Minister of Industry and Trade No. 290/MPP/Kp/6/1999.
To Stipulate:
DECREE OF MINISTER OF INDUSTRY AND TRADE ON AMENDMENT TO DECREE OF MINISTER OF INDUSTRY AND TRADE NO. 230/MPP/Kep/7/1997 ON GOODS SUBJECTED TO THE IMPORT TRADE SYSTEM AS ALREADY SEVERAL TIMES AMNDED, THE LATEST BY DECREE OF MINISTER OF INDUSTRY AND TRADE NO. 50/MPP/Kep/2/2000.
Article I
To amend the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 as follows:
1. Revoking Article 1 letter h.
2. Amending Article 6, so that it reads as follows:
"Article 6
(1) The import of motor vehicles in completely built-up (CBU) condition shall be realised by companies already prossessing import's identity numbers (API) or limited importer's numbers (APIT).
(2) Importers of motor vehicles as meant in paragraph (1) shall meet the following document requirements:
- a. Vehicle Identification Numbers (VIN) from manufacturing countries of origin, at least mentioning originating countries, manufacturing plants, specifications of types and years of manufacture;
- b. test certificates/evidence of types from the Ministry of Communications, for the types of motor vehicles imported exceeding 10 (ten) units;
- c. test certificates/evidence of types from manufacturing countries of origin or countries of origin of import for the types of motor vehicles imported up to 10 (ten) units;
- d. statements from importers on guarantee effective in Indonesia for quality and after sale service;
- e. other documents stipulated by the Director General of Metal, Machine, Electronic and Multifarious Manufacturing Industries.
(3) Importers already fulfilling the document requirements as meant in paragraph (2) shall register the motor vehicles to be imported with the Director General of Metal, Machine, Electronic and Multifarious Manufacturing Industries to obtain type registration marks (TPT). "
3. With the enactment of this Decree, all other provisions contained in the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 are declared valid.
Article II
This Decree shall come into force as from the date of stipulation.
For public cognizance, this Decree shall be placed in the State Grazette of the Republic of Indonesia.
